Part 1 — Terms and Conditions
Governing your use of retreatscapes.com
01Introduction
These Terms and Conditions ("Terms") govern your use of retreatscapes.com (the "Site"), owned and operated by Retreatscapes, a retreat inquiry and discovery platform based in Sydney, NSW, Australia.
By accessing or using this Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (Part 2 below). If you do not agree to every part of these Terms, you must not use the Site.
02About Retreatscapes — role limitation
Retreatscapes is a retreat discovery and inquiry platform only, and nothing more. Our sole function is to showcase retreat listings and facilitate initial inquiries between users and independent, third-party retreat providers.
Retreatscapes does not, under any circumstances:
Operate, manage, host, or run any retreat, event, or activity.
Act as a booking agent, travel agent, tour operator, or intermediary of any kind.
Enter into any contract on behalf of a provider or a user, or act as agent for either party.
Handle payments, deposits, refunds, or any financial transactions related to any retreat.
Guarantee the accuracy, completeness, safety, legality, or quality of any listing or provider.
Employ, supervise, or control any retreat provider, facilitator, or their staff.
Retreat providers are independent third parties. No provider is an employee, agent, partner, joint venturer, or representative of Retreatscapes. Nothing here creates a partnership, agency, or employment relationship between Retreatscapes and any provider or user.
Any arrangement made following an inquiry is exclusively between the user and the retreat provider. Retreatscapes is not, and will not become, a party to that arrangement, and accepts no responsibility for its formation, performance, or outcome.
03Eligibility & age restrictions
You must be at least 18 years of age to use this Site. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms. Retreatscapes accepts no responsibility for false statements about age or capacity, and you agree to indemnify Retreatscapes for any loss arising from such statements (Section 13).
04Types of retreat listings
4.1 Curated Retreats
Curated Retreats are reviewed on a reasonable, best-efforts basis only. This review is not an inspection, audit, or certification, and is no guarantee of any kind. Retreatscapes makes no warranty as to outcomes, safety, or accuracy of provider information. Participation in any retreat is entirely at your own risk.
4.2 Retreatscapes Network / Pop-Up Experiences
Pop-Up Experiences are community-listed retreats that have not been vetted by Retreatscapes. All bookings and communications are handled directly between the user and the provider. Retreatscapes assumes no liability whatsoever for issues arising from these listings.
4.3 Retreat Partner Membership
Some retreat owners and providers listed on the Site are Retreatscapes Members. Members pay an annual membership fee to Retreatscapes in exchange for their retreat or experience being showcased on the Site, including invite-only marketing placements, spotlight features, and curated collection inclusion.
A membership fee relates solely to the marketing, visibility, and promotional services Retreatscapes provides, and is not payment for a booking, a commission, or any guarantee of bookings, leads, or outcomes. Paying a membership fee does not constitute Retreatscapes' endorsement, certification, or guarantee of the quality, safety, or accuracy of a Member's retreat, and does not change a Member's status as an independent third party under Section 2. The vetting disclaimers, "as is" basis, and liability exclusions in Sections 4.1, 5, 7, and 12 apply equally to Members and non-Members alike.
05No warranties; "as is" basis
The Site and all listings are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for purpose, accuracy, or uninterrupted availability. Retreatscapes does not warrant that any description, image, price, or availability shown is current or accurate.
Not professional advice. Nothing on the Site is medical, psychological, dietary, financial, or legal advice. Consult a qualified professional before undertaking any retreat, especially one involving physical activity, fasting, isolation, or psychological practices.
06Booking disclaimer
Retreatscapes is inquiry-based only. We do not facilitate, process, or confirm bookings. Any booking is a direct transaction between you and the provider, to which Retreatscapes is not a party and bears no responsibility.
Before booking, you are solely responsible for:
Confirming dates, pricing, inclusions, accommodation, and cancellation policies directly with the provider.
Assessing suitability for your health, medical history, and personal circumstances — including medical clearance where appropriate.
Reviewing and agreeing to the provider's own terms and waivers.
Conducting your own due diligence on the provider's licensing, insurance, and reputation.
Arranging your own travel and health insurance, visas, and travel documents.
07Assumption of risk
Retreats may involve inherent risk — physical exertion, remote or foreign travel, exposure to natural environments, fasting, use of water, fire, animals, or equipment, and emotional or psychological practices. By inquiring or attending any retreat found through the Site, you voluntarily assume all such risks, known or unknown, and release Retreatscapes from any related claim to the fullest extent permitted by law.
08Privacy & data collection
Retreatscapes collects your name, email, phone number, and location/IP data when you use the Site or contact us. Full details are in Part 2 below.
09Cookies & third-party tracking
Our Site uses Google Analytics, Facebook Pixel, and Mailchimp. Continued use of the Site means you consent to these tools, without limiting our liability disclaimer for how any third-party tool operates or handles data. Full details in Part 2.
10Intellectual property
All Site content — text, images, logos, documents, and downloads — belongs to Retreatscapes or its content creators, and is protected by IP law. You may not reproduce, distribute, or commercially use Site content without prior written permission.
11Third-party goods, services & links
The Site may feature third-party goods, services, or links. Retreatscapes does not endorse or guarantee any of it, and accepts no liability whatsoever in connection with it. Review the terms and privacy policies of any third-party site you visit.
12No liability for retreat experiences
To the maximum extent permitted by law, we exclude all liability for anything occurring before, during, or after a retreat — regardless of how the connection was made or whether the listing was Curated or a Pop-Up. This includes, without limitation:
Personal injury, illness, disability, death, or physical harm, including while travelling to or from a retreat.
Psychological, emotional, or spiritual harm arising from a retreat or interaction with any provider or attendee.
Loss of, theft of, or damage to personal property.
Financial loss, including from provider insolvency or default.
Misrepresentation, negligence, or misconduct by a provider or third party.
Any failure of a retreat to meet expectations, regardless of how it was described.
Any indirect, incidental, special, consequential, or punitive damages.
Vetting disclaimer
Any vetting for Curated Retreats is best-efforts only and is not an endorsement or guarantee. It cannot account for changes in a provider's conduct after review. Listing on the Site does not imply Retreatscapes has verified or taken responsibility for a provider.
General liability cap
To the maximum extent permitted by law, Retreatscapes' total aggregate liability to you is limited to AUD $100 or the fees (if any) you paid directly to Retreatscapes in the preceding 12 months, whichever is lower — whether the claim arises in contract, tort, statute, or otherwise, even if a remedy fails of its essential purpose.
Nothing here excludes rights under the Australian Consumer Law that cannot be lawfully excluded. Where liability can only be limited, our liability is limited, at our option, to re-supply of the service or its cost.
13Indemnity
Except where prohibited by law, you agree to indemnify and hold harmless Retreatscapes and its directors, officers, agents, employees, contractors, and affiliates from claims, losses, and expenses (including legal fees) arising from your use of the Site, any retreat you attend as a result, any dispute with a provider, your breach of these Terms, or any false statement regarding age, health, or capacity.
14Force majeure
Retreatscapes is not liable for failures or delays caused by events beyond our reasonable control, including natural disaster, pandemic, government action, or outages of third-party services we rely on (hosting, Mailchimp, Google, Meta).
15Dispute resolution
Contact us first to seek an informal resolution. If unresolved within 30 days, either party may pursue mediation before legal proceedings. Retreatscapes is not a party to any dispute between a user and a provider.
16Governing law
These Terms are governed by the laws of New South Wales, Australia. Legal proceedings must be brought exclusively in NSW courts, and you consent to their exclusive jurisdiction.
17Entire agreement; no waiver
These Terms and the Privacy Policy are the entire agreement between you and Retreatscapes regarding the Site. Our failure to enforce any provision is not a waiver of it.
18Severability
If any provision is found invalid, it will be severed to the minimum extent necessary and reformed to reflect the original intent. All remaining provisions continue in force.
19Changes to these Terms
We may update these Terms at any time. Material changes will be notified by email or Site notice. Continued use after changes means you accept the update.

Part 2 — Privacy Policy
How we collect, use, and protect your information

Retreatscapes ("we", "us", "our") is committed to protecting your personal information and privacy. This policy explains what we collect, how we use it, who we share it with, and your rights.

03Information we collect
Provided directly
Full name, email address, phone number, and the content of your inquiry via our contact form.
Collected automatically
IP address and approximate location, browser and device type, pages visited, time on site, and referring URLs.
Third-party tools
Google Analytics (anonymised usage data), Facebook Pixel (ad measurement), Mailchimp (subscriber management for opted-in users).
04How we use your information
To respond to inquiries and connect you with providers; to improve your Site experience; to send marketing emails to opted-in subscribers; to analyse traffic and ad performance; to comply with legal obligations.
05Legal basis — EU/UK (GDPR)
Consent (marketing, cookies — withdrawable any time); legitimate interests (usage analysis); legal obligation (where required by law).
06How we share your information
We do not sell your personal information. We share it with retreat providers (to respond to your inquiry), third-party processors (Google, Meta, Mailchimp), and legal or regulatory authorities where required.
07Cookies & tracking
Essential, analytics (Google Analytics), and marketing (Facebook Pixel) cookies. Manage or disable via your browser at any time; disabling may affect functionality.
08International data transfers
Data may transfer outside Australia, including to the US. EU/UK: Standard Contractual Clauses under GDPR. Australia: compliance with the Australian Privacy Principles on cross-border disclosure.
09How long we keep your data
Inquiry data: up to 2 years. Subscriber data: until unsubscribe or deletion request. Analytics data: per Google/Meta defaults (typically 26 months).
10Your privacy rights
All users — Australian Privacy Principles
Access, correction, and the right to complain about a breach of the APPs.
EU/UK users — GDPR
Erasure, restriction, portability, objection, withdrawal of consent, and the right to lodge a complaint with your national DPA.
California users — CCPA
Right to know, right to delete, right to opt out of sale (we don't sell data), and non-discrimination.
To exercise any right, contact hello@retreatscapes.com. We respond within 30 days.
11Data security
We take reasonable steps to protect your data, but no method of internet transmission is 100% secure. We'll notify affected users and authorities of any serious data breach as required by law.
12Children's privacy
The Site is not directed to individuals under 18. If a minor has submitted information, contact us and we'll delete it promptly.
13Email marketing
Subscriber details are stored via Mailchimp. You'll only receive marketing emails if you've explicitly opted in. Unsubscribe any time.
14Changes to this policy
Material changes will update the "Last Updated" date and be notified by email or Site notice.
15Complaints & contact
Contact hello@retreatscapes.com. We acknowledge complaints within 5 business days and aim to resolve within 30.
